Georgia prosecutor seeks Aug. 5 trial date for Trump, 14 co-defendants in election interference case

A judge in Atlanta is set to hear arguments on Tuesday regarding a request to revoke the bond of former President Donald Trump's co-defendant, Harrison Floyd, in the Georgia case related to efforts to overturn the 2020 election. Fulton County District Attorney Fani Willis filed a motion last week asking the county Superior Court Judge Scott McAfee to revoke Floyd's bond, alleging that he has been attempting to intimidate and contact witnesses and co-defendants in violation of his release terms.

According to Willis, Floyd's actions involve intimidating and contacting likely witnesses and co-defendants, which goes against the conditions of his release. Floyd's attorneys, however, argue that the allegations are without merit and that the motion is a retaliatory measure against their client. They claim that Floyd neither threatened nor intimidated anyone and did not communicate with any witness or co-defendant directly or indirectly.

The charges against Floyd stem from allegations of harassment towards Ruby Freeman, a Fulton County election worker who was falsely accused of election fraud by Trump and his supporters. Floyd participated in a conversation on January 4, 2021, in which Freeman was pressured to lie about participating in election fraud. Floyd, a leader in the organization Black Voices for Trump, was one of 18 people charged, including Trump, in a sprawling indictment in August. The indictment accuses them all of participating in a wide-ranging scheme to illegally keep Trump in power after he lost the election to Joe Biden.

While four defendants have pleaded guilty and reached a deal with prosecutors that includes testifying in any trials, Trump and the other defendants have pleaded not guilty. Although no trial date has been set, Willis requested McAfee to schedule it for August 5, 2024. Floyd is the only defendant who spent time in jail after his indictment because he did not have a lawyer negotiate bond conditions before turning himself in.

Willis' motion to revoke Floyd's bond cites numerous social media posts made by Floyd in recent weeks. The posts include attacks on Georgia Secretary of State Brad Raffensperger and mentions of Freeman, both of whom are likely witnesses in the case. Floyd's attorneys argue that Trump's social media posts about his co-defendants were not subjected to the same scrutiny, and they claim that Floyd's posts are protected political speech under the First Amendment.

The prosecutor in Georgia, Fani Willis, is seeking an August trial date for Trump and the other defendants charged in the case. Willis filed a motion to schedule the trial for August, taking into consideration potential delays from Trump's other criminal trials and the defendants' constitutional speedy trial rights. The decision on the trial date lies with Judge Scott McAfee.

Trump's lead attorney in Georgia, Steve Sadow, opposes Willis' motion and has requested a hearing on the issue. If the trial starts in August, it would coincide with the general election in November and fall within a year of the indictment. Willis also asked the judge not to consider any requests to sever the defendants' trials until after the final plea date of June 21. She argued that trying all defendants together would serve the interest of judicial economy, especially considering the shared evidence and witnesses in the case.

Willis has previously stated that the trial is likely to last "many months," potentially extending into 2025. Trump currently faces multiple trials, including one in Washington on March 4 for federal charges related to election interference, one in New York on March 25 for state charges related to hush money payments, and one in Florida on May 20 for federal charges connected to handling classified documents. Willis has maintained that the timing of the trial is not influenced by the 2024 election cycle.

Floyd's case is significant as he is the only defendant who did not have bond conditions negotiated before his indictment. Willis alleges that Floyd's social media posts violate the conditions of his release, while Floyd's attorneys argue that his posts are protected political speech. The judge will hear arguments on Tuesday before making a decision regarding the revocation of Floyd's bond.
