Former Baltimore Prosecutor Marilyn Mosby Convicted of Federal Perjury

00:33 10.11.2023

Former Baltimore prosecutor Marilyn Mosby has been found guilty of perjury for making false statements on loan applications for two vacation homes in Florida, according to the Justice Department. Mosby, who gained national attention for charging six police officers in the 2015 death of Freddie Gray, pleaded not guilty to two counts of perjury and two counts of making false statements last year. She is accused of applying for loans to withdraw money from her retirement accounts using a CARES Act provision intended for those financially impacted by the pandemic. Mosby is facing a maximum sentence of five years in prison for each count of perjury.

In a separate federal case, Mosby is also charged with making false mortgage applications for the vacation homes. A trial date for that case has not yet been set. According to the indictment, Mosby lied on the applications by indicating she suffered adverse financial consequences due to the pandemic, despite earning a gross salary of nearly $248,000 in 2020. She also failed to disclose her federal back taxes and allegedly misrepresented her intention to be the primary resident of one of the homes.

During the trial, Mosby's lead attorney argued that she told the truth on the loan application, claiming that her travel business was significantly impacted by the pandemic. However, prosecutors argued that the business was not functioning and did not experience any adverse financial consequences.

Mosby's conviction comes after a high-profile career as Baltimore's state's attorney, where she prosecuted the officers involved in Freddie Gray's death. Gray died from a spinal cord injury sustained while in police custody. While none of the officers were convicted, the case led to police reform measures in Baltimore and across the country, including requirements for seatbelts in police vans and the use of body cameras.

Mosby, who ran on a platform of progressive prosecution, has also faced criticism for her handling of other cases and policies, including her decision to stop prosecuting certain low-level offenses. She lost her bid for a third term as state's attorney after being indicted on federal charges.

Mosby's sentencing for the perjury conviction has not yet been scheduled. She also still faces charges of mortgage fraud related to the vacation homes.
