Cosby faces new lawsuit for alleged abuse under expiring NY survivors law

03:01 22.11.2023

Several women have come forward with new lawsuits against actor Bill Cosby under New York's expiring Adult Survivors Act, which allows victims of sexual abuse to file claims that would otherwise be barred by time limits. The latest lawsuit, filed by an anonymous woman who worked as a stand-in on "The Cosby Show" in the 1980s, alleges that Cosby drugged and sexually abused her after offering to mentor her in her acting career. The accuser claimed that Cosby, known for his wholesome image as "America's Dad," initially offered style tips and acting exercises but later invited her to his home. She said she blacked out during an acting exercise after drinking wine that was apparently laced with drugs and woke up partially undressed and vomiting into a toilet.

The lawsuit also accused Cosby of false imprisonment, battery, assault, and intentional infliction of emotional distress. NBCUniversal, Kaufman Astoria Studios, and The Carsey-Werner Company, which are associated with the production of "The Cosby Show," are also named in the lawsuit for negligence related to Cosby's alleged behavior.

This lawsuit adds to the numerous allegations Cosby has faced from over 60 women, including several lawsuits filed under the Adult Survivors Act. Cosby's spokesperson, Andrew Wyatt, declined to comment on the specifics of the lawsuit but criticized the look-back windows in New York and other states, stating that they were being abused to target wealthy celebrities.

Joan Tarshis, a journalist and publicist, also filed a lawsuit against Cosby under the Adult Survivors Act. Tarshis previously accused Cosby of sexually assaulting her in 1969 or 1970 when she was a young comedy writer. She claimed that Cosby drugged her and forced her to perform oral sex on him during their first encounter and then drugged and raped her during another encounter a year or two later. Tarshis met Cosby through a mutual friend while he was starring in "The Bill Cosby Show."

Tarshis had previously sued Cosby in Massachusetts, along with six other women, for defamation after Cosby called them liars. The cases were settled in 2019. In her new lawsuit, Tarshis seeks unspecified damages for the physical and psychological injuries she suffered due to Cosby's alleged actions.

The Adult Survivors Act, which opened a one-year lookback window for adult survivors of sexual offenses to sue their alleged abusers, is set to expire soon. Other celebrities, including music executive L.A. Reid and Sean Diddy Combs, have also been sued under this law for sexual assault allegations.

Cosby, who was the first celebrity to be tried and convicted in the #MeToo era, spent nearly three years in prison before his conviction was overturned and he was released in 2021. Cosby's spokesperson argues that the look-back windows should be stopped to prevent further targeting of successful celebrities.

These lawsuits highlight the ongoing legal battles surrounding Bill Cosby and the importance of providing survivors of sexual abuse with a chance to seek justice, even years after the alleged incidents occurred.
