Donald Trump Jr. returning to the stand in New York fraud trial as defense's first witness

07:45 14.11.2023

Democratic New York Attorney General Letitia James was seen smirking as Donald Trump Jr. took the stand in his father's civil trial on Monday. The trial, which has been ongoing for several weeks, revolves around fraud charges leveled against former President Donald Trump and his two adult sons, who are co-defendants in the case. James, who had previously campaigned on prosecuting Trump, has denied that her charges are politically motivated.

The courtroom camera captured the moment when James appeared gleeful as Trump Jr. prepared to give his testimony. This incident was reminiscent of Judge Arthur Engoron, who oversaw the trial, striking a pose for the cameras with a giant grin and a comical shrug. The tension between Trump, James, and Engoron has been so heated that the judge issued a gag order against the former president after he publicly criticized the court.

During an interview on Fox News' "Sunday Morning Futures," Trump attorney Alina Habba accused James of having political motivations behind the trial. Habba argued that James should dismiss the case, stating that it was making her look bad and that the city needed her attention elsewhere. Habba also mentioned that James campaigned on prosecuting Trump before becoming attorney general.

Habba further criticized James for putting her nose into private companies' affairs, stating that the law she was using, a consumer fraud law, was not meant to be used in this way. She claimed that the lenders Trump worked with, such as Deutsche Bank, were not harmed and were paid on time with interest. Habba expressed frustration with the judge, accusing him of being motivated by the other side and making nonsensical decisions.

Regarding Trump's children's involvement in the trial, Habba emphasized that they were not involved and did not fit into the case. She claimed that their inclusion was a tactic to generate more press and impact for James. Habba defended the Trump children, stating that they had done nothing wrong and that no corruption or conspiracy existed.

In the trial, Trump Jr. is expected to testify for the second time, as the defense begins calling witnesses. In his previous testimony, he stated that he relied on the Trump Organization's accountants for the financial statements in question. His siblings, Eric Trump and Ivanka Trump, as well as their father, have also been called to the stand.

Judge Engoron had ruled in a pretrial ruling that the financial documents fraudulently overstated Donald Trump's wealth and property values. James' office argues that this allowed the Trumps to secure better deals with banks and insurers. Trump and his co-defendants have denied any wrongdoing, and the trial is also addressing allegations of falsification of business records and conspiracy.

The trial will also determine the amount of disgorgement or the state's share of ill-gotten gains. Trump is also facing four other trials, including federal charges related to his actions leading up to January 6th and his handling of classified documents, a New York case involving hush money payments to Stormy Daniels, and a Georgia case involving efforts to reverse the 2020 election results.
