Pregnant Kentucky Woman Suing for Abortion Discovers Embryo's Lack of Heartbeat

A pregnant woman in Kentucky, known as Jane Doe, who had filed a lawsuit against the state's near-total abortion bans, has received news that her embryo no longer has a heartbeat, according to her lawyers. Jane Doe, who was about eight weeks pregnant at the time of filing, stated in a press release that she did not want to be pregnant and believed that everyone should have the right to make their own decisions about their pregnancies. The lawsuit seeks to challenge the state's two abortion laws, including a "trigger law" that prohibits almost all abortions except in cases where the health of the mother is at risk, and a six-week ban that prohibits abortion once cardiac activity is detected in the embryo. The plaintiff is seeking class-action status for the case to include other Kentucky residents in similar situations. The case comes as Texas is also dealing with a similar legal battle over restrictive abortion laws. The Kentucky plaintiff's lawyers have not commented on how the health news would affect the lawsuit. The ACLU's Reproductive Freedom project is representing Jane Doe and is seeking additional plaintiffs to join the suit. The lawsuit argues that Kentucky's abortion bans violate the rights to privacy and self-determination under the state constitution and highlights the physical, emotional, and economic consequences women face when unable to access abortions. The suit names Kentucky Attorney General Daniel Cameron and Eric Friedlander, the secretary of Kentucky's Cabinet for Health and Family Services, as defendants. Both laws were passed by Republican legislative majorities. Kentucky's Supreme Court previously refused to halt the state's abortion bans, leaving patient-led challenges as the only path forward to challenge the bans. The plaintiff's lawyers have vowed to do everything they can to restore abortion access in Kentucky.
