Prosecutors investigating Rust shooting intend to bring involuntary manslaughter charge against Alec Baldwin before a grand jury

In a shocking turn of events, special prosecutors in New Mexico have announced their intention to recharge actor Alec Baldwin with involuntary manslaughter in connection with the fatal shooting on the set of the movie Rust in October 2021. The incident resulted in the death of cinematographer Halyna Hutchins and the injury of director Joel Souza. Baldwin, who is also a co-producer of the film, was pointing a gun at Hutchins during a rehearsal when the gun went off, causing the tragic accident.

The decision to recharge Baldwin comes after new evidence and additional facts have come to light. Prosecutors Kari Morrissey and Jason Lewis have stated that they will present this evidence to a grand jury within the next two months. The case had initially been dismissed in April, as there were concerns that the gun used by Baldwin may have been modified and malfunctioned. However, a new analysis of the gun conducted by experts in ballistics and forensic testing has led to a shift in their position.

The gun analysis, led by Lucien Haag of Forensic Science Services in Arizona, utilized replacement parts to reassemble the gun fired by Baldwin. Previous testing by the FBI had resulted in broken parts of the pistol. The new analysis examined the gun and the markings it left on a spent cartridge, ultimately concluding that the trigger must have been pulled or depressed for the gun to fire. This directly contradicts Baldwin's claim that he pulled back the hammer but did not pull the trigger.

Hannah Gutierrez-Reed, the weapons supervisor on the movie set, has already pleaded not guilty to charges of involuntary manslaughter and evidence tampering. Her trial is scheduled to begin in February. Additionally, David Halls, the assistant director and safety coordinator of "Rust," pleaded no contest to a conviction for unsafe handling of a firearm in March. He received a suspended sentence of six months of probation and has agreed to cooperate in the investigation.

The 2021 shooting incident has sparked a series of civil lawsuits, with accusations of lax safety standards against the defendants. Members of Hutchins' family have filed wrongful death claims, which are currently ongoing. Baldwin and the other defendants have vehemently denied any wrongdoing and disputed the accusations against them.

NBC News has reported that Baldwin's case will be brought before a grand jury in mid-November, with potential charges carrying a sentence of up to 18 months in prison if convicted. There were recent discussions of a plea deal, although it is unclear if any progress has been made in that regard. Baldwin's attorneys and the special prosecutors have not yet provided any comments on the matter.

This latest development comes after the previous charges against Baldwin were dropped in April due to the possibility of the gun being modified and malfunctioning. However, the subsequent gun analysis, which confirmed the findings of the FBI's previous testing, has led to a reconsideration of the case.

The tragic incident on the set of Rust has had far-reaching consequences, affecting not only the individuals directly involved but also the broader entertainment industry. The wrongful death suit between Baldwin and Rust producers was settled in June, with Hutchins' husband expressing gratitude for the support and tribute to her final work. Production on the film has since resumed, with Hutchins posthumously serving as an executive producer.

As the legal proceedings continue, the industry and the public are left grappling with the devastating loss of Hutchins and the questions surrounding the safety measures on the Rust set. The outcome of Baldwin's potential recharge will undoubtedly have significant implications for the future of on-set safety protocols and the accountability of those involved in film production.
