Second death linked to Panera Bread's Charged Lemonade sparks lawsuit

Panera Bread is facing a second lawsuit following the death of a Florida man who consumed three servings of the company's highly caffeinated Charged Lemonade. The lawsuit was filed on Monday by the family of Dennis Brown, who suffered a fatal cardiac arrest after drinking the beverage at a local Panera in October. Brown, 46, had a chromosomal deficiency disorder, developmental delay, and ADHD, but lived independently and worked at a grocery store for nearly 17 years. He also had high blood pressure and did not consume energy drinks. The lawsuit claims that the Charged Lemonade was not advertised as an energy drink and did not come with any warnings about the potentially dangerous effects of consuming concentrated amounts of caffeine and sugar. This is the second lawsuit linking the beverage to a death, with the first lawsuit filed in October by the family of 21-year-old Sarah Katz, who had a heart condition and died in September 2022 after drinking the product. The lawsuits allege that a large Mango Yuzu Citrus Charged Lemonade contains 390 milligrams of caffeine and 124 grams of sugar. Panera denies any connection between the deaths and its caffeinated drinks, stating that they stand by the safety of their products. The company has since updated its website to include warnings about consuming the Charged Lemonades in moderation. The Food and Drug Administration states that it is safe for a healthy adult to consume up to 400 milligrams of caffeine a day, and that sugars should make up less than 10% of total calories. Panera, which is privately held by German investment firm JAB Holding Co., operates over 2,000 eateries in the US and Canada.
