Judge denies defense motion to dismiss Hunter Biden's federal gun case

06:16 13.04.2024

A federal judge in Delaware, U.S. District Judge Maryellen Noreika, has refused to dismiss a federal gun case against Hunter Biden, the son of President Joe Biden. The judge rejected Hunter Biden's claims that he is being prosecuted for political reasons and denied several defense requests to dismiss the case. This ruling increases the likelihood that Biden could face trial as early as June, right in the middle of his father's reelection campaign.

The case against Hunter Biden involves allegations that he lied about his drug use in October 2018 on a form to buy a gun that he kept for about 11 days. His lawyers argued that the case was politically motivated and that an immunity provision from an original plea deal should still hold. They also challenged the appointment of Delaware U.S. Attorney David Weiss as special counsel to lead the prosecution.

Despite these arguments, Judge Noreika has not yet ruled on the constitutionality of the gun charges. Hunter Biden has pleaded not guilty to the charges. His legal team has not responded to requests for comment on the recent ruling.

In addition to the gun case, Hunter Biden is also facing separate tax counts in Los Angeles, alleging that he failed to pay at least $1.4 million in taxes over three years while living an "extravagant lifestyle" during his drug use days. The judge overseeing that case has denied motions to dismiss the charges, and the trial is also set to begin in June.

Overall, Hunter Biden is facing legal challenges on multiple fronts, with both the gun case and the tax case moving forward towards trial. The president's son continues to maintain his innocence and argues that he is being unfairly targeted for political reasons.
