LA man who defended home from armed intruders faces uphill battle to get gun permit back

A Los Angeles homeowner, Vince Ricci, who used his concealed carry weapon (CCW) to defend his home against armed attackers may face difficulties in getting his permit reinstated. The Los Angeles County Sheriff's Department (LASD) possesses a vast amount of discretion to revoke a person's constitutional right to carry a firearm, according to Amy Swearer, a senior legal fellow at the Heritage Foundation. Ricci found himself in a gunfight when two armed men attempted to force their way into his home after jumping the fence of his gated community. Concerned for the safety of his wife, 5-month-old daughter, and the family's nanny, Ricci fought back using a hot cup of tea and eventually his gun. Surveillance footage captured the intense encounter, showing the intruders retreating from Ricci's gunfire. However, Ricci's success in defending his family has resulted in authorities targeting him. Shortly after the incident, Ricci received a call informing him that his concealed carry license had been revoked due to him allegedly yelling at Los Angeles police officers during their investigation. Ricci expressed his frustration, stating that his Second Amendment rights had been suspended by California despite him protecting his loved ones in his home. The LASD responded to the situation, acknowledging the trauma experienced by the Ricci family and expressing their hope for the apprehension and accountability of the individuals responsible for the crime. The LASD emphasized that the Department of Justice (DOJ) establishes guidelines for CCW permits, and they must adhere to these guidelines. They also clarified that Ricci could reapply for his permit and that the agency was providing him with information about CCW protocols and guidelines to protect his Second Amendment rights. However, Swearer challenged the LASD's claim, questioning the specific DOJ guidelines they referenced. She argued that LASD's decision to revoke Ricci's permit may not be based on state law or DOJ guidelines but rather on the additional "terms and conditions" agreement that LASD requires CCW applicants to sign. Swearer highlighted that California law enforcement agencies possess broad discretion in issuing and revoking concealed carry permits, making it uncertain whether Ricci has avenues to regain his Second Amendment rights. She criticized the overall anti-Second Amendment mindset of LASD and California lawmakers, suggesting that recent Supreme Court rulings have made it harder for authorities to deny licenses but have prompted them to find alternative ways to restrict firearm possession. Despite the limitations imposed by the court, California still has the ability to impede its citizens' ability to carry firearms, Swearer argued.
