Judge Rejects Kari Lake's Request to Examine Ballot Envelopes in Lawsuit Related to Arizona Election

Maricopa County Superior Court Judge John Hannah Jr. has rejected former Arizona Republican gubernatorial candidate Kari Lake's request to examine the signed ballot envelopes of 1.3 million early voters in last year's election. This marks Lake's third loss in court related to her election challenges. In his order, Judge Hannah argued that releasing the envelopes would undermine the ballot verification process in future elections. He stated, "The broad right of electoral participation outweighs the narrow interests of those who would continue to pick at the machinery of democracy."

Lake's attorney, Bryan Blehm, has not yet responded to requests for comment. While Lake has not directly commented on social media, she has been retweeting supportive posts on X, formerly known as Twitter. The majority of the two-day bench trial was focused on testimony from Maricopa County Recorder Stephen Richer, who is named as a defendant in the case. Richer explained that Lake's initial request to see the envelopes was denied because state law mandates that ballot envelope signatures remain confidential.

According to Arizona law, the envelopes for early voting ballots serve as affidavits in which voters declare, under penalty of perjury, their eligibility to vote. Releasing the ballot affidavit envelopes could potentially have a "chilling effect" on voters and lead to individuals either not voting or deliberately not signing their ballots, Richer argued. Blehm, on the other hand, contended that signatures are already public in other documents, such as property deeds, and therefore should be available for examination.

Judge Hannah compared Lake's attempts to examine the signed envelopes to villagers wanting to inspect a goose that lays golden eggs, stating, "If only she could cut open the electoral process and examine each of its 1.3 million pieces, she says, she would be able to figure out what happened and show that the prize has been there waiting for her all along." He emphasized the importance of maintaining confidence in the electoral process and ensuring reliable outcomes.

Lake has previously lost two trials challenging her loss to Democratic Governor Katie Hobbs by over 17,000 votes. Her latest lawsuit focuses on a public records request to review all early ballot envelopes with voter signatures in Maricopa County, which was denied by officials. Lake has been a vocal proponent of former President Donald Trump's election fraud claims and is considering a run for the U.S. Senate. She is also regarded as a potential running mate for Trump in his 2024 campaign. The trial is set to resume on Monday.
