US Judge Delays Trial for Trump's Election Subversion Case

06:29 03.02.2024

In a formal confirmation of what had been anticipated for weeks, Judge Chutkan issued an order scrapping the March 4 trial date for the case against former President Donald J. Trump. This decision came as no surprise, as the judge had been dropping hints about delaying the trial while Trump pursued his argument of complete immunity from prosecution.

In her order, Judge Chutkan stated that she would set a new date for the trial in Federal District Court in Washington once Trump's immunity claims were resolved. These claims are currently being reviewed by a three-judge panel of the United States Court of Appeals for the District of Columbia Circuit. Despite expressing skepticism about Trump's position, the panel has yet to reach a decision after setting an aggressive schedule for briefings.

The delay of the trial marks the latest development in the ongoing battle between Trump's legal team and the special counsel, Jack Smith. Trump's lawyers have been using every means at their disposal to push the start of the trial until after the fall's election is decided.

District Judge Tanya Chutkan officially removed the March 4 trial date for the federal case against former President Donald Trump, which is related to the 2020 presidential election. This decision comes as higher courts consider Trump's claim of immunity from federal prosecution. Chutkan's order vacated the previously set trial date and indicated that a new schedule would be determined based on the outcome of the dispute over Trump's immunity.

Trump faces four counts brought by special counsel Jack Smith regarding an alleged attempt to overturn the results of the 2020 presidential election. He has pleaded not guilty. Chutkan had previously rejected Trump's claim of presidential immunity, stating that presidents do not have a get-out-of-jail-free pass. Trump appealed this decision, leading Chutkan to pause all proceedings in the case.

The Court of Appeals for the District of Columbia Circuit heard arguments on whether Trump can be prosecuted for actions taken while in office and has yet to issue a decision. Chutkan's decision to scrap the trial date may complicate the timeline for other jurisdictions where Trump is facing charges. Smith is also prosecuting Trump on 40 counts in federal court in South Florida for alleged mishandling of classified documents, with the trial currently scheduled for May 2024. Additionally, Trump is facing state charges in New York, where Manhattan District Attorney Alvin Bragg has charged him with 34 felony counts of falsifying business records. The trial for those charges is set to begin in late March.

The ruling by Judge Chutkan paves the way for the trial on state charges in New York and further delays the federal trial against Trump. The delay in the federal trial allows Trump's legal team more time to build their case and potentially influence the outcome of the trial. The decision also raises questions about the potential impact on the 2024 presidential election, as Trump's legal battles continue to unfold.
