Mother files lawsuit against Georgia hospital over alleged decapitation during childbirth

A lawsuit has been filed against Southern Regional Medical Center in Riverdale, Georgia, after a baby was allegedly decapitated during delivery. Jessica Ross, 20, went to the hospital's emergency room on July 9 after her water broke. She began pushing at 8:40 p.m., but the baby stopped descending due to shoulder dystocia, a condition where the baby's shoulders cannot fit through the pelvic area. The lawsuit claims that Dr. Tracey St. Julian, who is also named in the lawsuit, attempted to deliver the baby vaginally using different methods, including applying excessive force to the baby's head. This resulted in the bones in the baby's skull, face, and neck being broken. At around 11:50 p.m., St. Julian decided to perform a STAT Cesarean section, and the baby's body and legs were delivered at 12:11 a.m., followed by the baby's head being delivered vaginally. The lawsuit alleges that St. Julian failed to inform Ross and her family about the decapitation and that the hospital discouraged the family from seeking an autopsy, instead suggesting they have their son cremated. A report of the alleged decapitation was never made to authorities, and the death was flagged by a funeral home. The lawsuit also accuses St. Julian of gross negligence and failure to perform a timely and proper cesarean section. The hospital denies the allegations and states that St. Julian is not an employee. The complaint is seeking unspecified damages for the full value of the baby's life. The hospital cannot discuss patient care due to privacy laws but expressed condolences to the family and stated that it has taken appropriate steps in response to the situation. The attorneys representing Ross and Taylor stated that the hospital attempted to cover up the decapitation by discouraging an autopsy and encouraging cremation. The lawsuit alleges gross negligence, fraud, and intentional infliction of emotional distress.
