Federal judge blocks California law banning firearms in public places

09:04 21.12.2023

In a significant ruling on Wednesday, a federal judge blocked a California law that would have prohibited carrying firearms in most public places. District Judge Cormac Carney deemed the law to be a violation of the Second Amendment of the U.S. Constitution, stating that it deprives individuals of their ability to protect themselves and their loved ones. The law, which was signed by Governor Gavin Newsom in September, was scheduled to go into effect on January 1. It would have banned the carrying of concealed guns in 26 locations, including public parks and playgrounds, churches, banks, and zoos, regardless of whether the individual had a permit to carry a concealed weapon.

However, the ban would not apply to privately owned businesses that allowed guns on their premises. Judge Carney granted a preliminary injunction blocking the law, describing it as "sweeping, repugnant to the Second Amendment, and openly defiant of the Supreme Court." The lawsuit against the law will continue while the law is blocked, and gun rights groups are expected to succeed in proving its unconstitutionality, potentially leading to its permanent overturning.

The California Rifle and Pistol Association, which filed the lawsuit to block the law, hailed the judge's decision as a victory. Chuck Michel, the president of the association, criticized California's progressive politicians for attempting to circumvent the Supreme Court's ruling in the New York State Rifle and Pistol Association v. Bruen case. Michel argued that the law would have prevented gun permit holders from traveling across town without breaking the law by passing through prohibited areas.

California's Attorney General, Rob Bonta, expressed his intention to appeal the decision, warning that allowing guns in places where families and children gather would endanger communities. Governor Newsom also condemned the ruling, calling it an affront to California's efforts to promote gun safety. Newsom, who has positioned himself as a national leader on gun control, has been pushing for stricter gun measures and has signed various bills targeting untraceable "ghost guns" and the marketing of firearms to children.

The ruling has sparked a debate on the balance between gun rights and public safety. Supporters of the decision argue that law-abiding citizens should have the ability to defend themselves, while opponents argue that allowing guns in public places increases the risk of violence. The National Rifle Association (NRA) applauded the ruling, stating that it reaffirms Americans' constitutional right to carry firearms for self-defense.

The case highlights the ongoing tensions and legal battles surrounding gun control in the United States. It also underscores the potential political implications for Governor Newsom, who is increasingly being viewed as a potential presidential candidate. As California continues to grapple with this divisive issue, the debate over gun rights and public safety shows no signs of abating.
